US EPA references ASTM E1527-21 Standard as AAI-Compliant under CERCLA

On December 15th, 2022, the US EPA published notice in the Federal Register officially amending the All-Appropriate Inquiries Rule at 40 CFR Part 312 to reference ASTM International’s E1527-21 “Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process” and allow for its use to satisfy the requirements for conducting all appropriate inquiries under CERCLA. In the notice, the EPA also responded to the negative comments received in response to its March 2022 proposal to amend AAI.

In our September survey on the industry’s transition to E1527-21, 28% of environmental professionals were waiting until the USEPA recognized -21 as an avenue for AAI compliance while 31% had already begun following -21 exclusively. The US EPA’s announcement is a trigger for broader adoption of ASTM’s updated Standard Practice.
